Throughout the semester we have learned about the inner workings of the criminal court system. We have paid attention to the various constitutional rights that guarantees defendants’ rights are not infringed on. We have also learned the role of the courtroom actors including the responsibilities and duties of the prosecutor, defense, judge, jury. We further learned about the rights of victims. Lastly, we learned the various procedural stages within a criminal trial from the pretrial procedures through sentencing and appeals.
Your final writing assignment asks you to apply what you have learned to one high-profile criminal court case. This can be any case you have an interest in extensively examining. The only limitations are that it must be analyzed from the trial court stage, and you must be able to gather enough information to write a comprehensive paper including accessing primary legal sources.
Your paper must include the following:
A fact section (no more than 1 page)
Provide an overview of the case you chose, including the relevant facts that led up to the commission of the crime and the crime itself. Also discuss why this case received national/international attention. Make sure to include the pertinent facts that help to explain the key legal issue you discuss.
identify the actors in the case. Who is the defendant, prosecutor, defense attorney, and judge in this case? Are there any witnesses that are particularly important to your examination?
Procedural history (no more than 2 page)
What crimes was the defendant charged with?
How did the defendant plead?
What was the legal theory of the case?
What was the defense strategy? For example, was self-defense proposed? Insanity defense?
What was the outcome of the case? Guilty/not guilty?
Sentencing
Key issue of this case (the meat of your paper)
Here you must identify one key legal issue your chosen case exemplifies and thoroughly examine it. Issues can be at any stage of the criminal court process. You must engage with the textbook and outside sources to thoroughly examine the issue. Some examples of significant issues include:
Jurisdictional issues.
The inability to find a fair and impartial jury.
Was their prosecutorial of judicial misconduct? Or ineffective assistance of defense counsel?
Any evidential issues?
Jury nullification?
In your analysis you must include how the issue was relevant to the due process rights of the defendant. In other words, what are the due process implications of the case you examined? Here you should engage with legal sources (example, legal precedent, statues, the Constitution etc.)
Conclusion
Provide a summary of the events post-trial court stage. For example, did the key issue get appealed? What was the ultimate outcome of the case?
Other details:
Paper must be 4-6 pages, double spaced with 1-inch margins and standard 12-point font.
Paper must adhere to APA manual (6th or 7th edition)
Paper must include at minimum 5 outside sources. This should be a mix of primary legal sources (such as the indictment or jury instruction) and secondary sources (including news articles, reports, scholarly articles).

Provide a 2-3 sentence overview of the case. State how you think this case exemplifies a legal issue we have discussed in class (or will be discussing).
List 3 sources specific to the case you have chosen. This can include new articles or primary legal sources.
