Final Policy Memo & In-Person/Zoom Consultation This course fulfills the requirement for a writing-intensive course. Your final will thus consist of a writing assignment. Please plan ahead– late submission of the final will result in a drop of one letter grade per day late. I will grant extensions for justifiable reasons provided that you e-mail me before the day the final memo is due. The final should be submitted via the D2L course page under “Assignments.” There, you will also find more instructions and the grading rubric that will be used to evaluate your work. • Final Memo – due Saturday, May 7th at 11:59PM: You have been hired as a consultant by Greenpeace, a non-governmental organization (NGO) advocating for environmental sustainability and mitigating climate change, with offices in the US and over 50 countries worldwide. In particular, you have been tasked by Kristin Casper – the head of the Legal Unit at Greenpeace – with writing a 7-page policy memo (using 12-point Times New Roman font, double spaced with 1 inch margins) evaluating the suitability of litigation as a strategy to pursue Greenpeace’s environmental advocacy. Ms. Casper also wants to know whether Greenpeace’s US office should follow its offices in countries like the UK that have prioritized strategic litigation. Your policy memo should be divided into an executive summary (a paragraph summarizing your argument/findings), and then three sections – with clear section headings – answering three questions: POL 469 – Law & Social Change, Spring 2022 – Prof. Tommaso Pavone 4 1. What are the potential costs and benefits of litigation as a strategy to pursue social change? 2. Under what conditions would environmental litigation supported by Greenpeace be most likely to succeed – and how should Greenpeace define ‘success’? 3. Should Greenpeace’s US office allocate new resources to environmental litigation initiatives or should it prioritize alternative strategies, such as lobbying or organizing protests? In writing the memo, you should draw upon/cite at least four readings/materials from class – and at least two must be from after spring break. Be specific in referencing these readings/materials and demonstrate your command of the material! Finally, doing some additional research by consulting the below sources and incorporating them into your memo is recommended and will boost your grade: o Greenpeace’s Legal Unit page, with information on Greenpeace-initiated lawsuits: https://www.greenpeace.org/international/explore/about/legal/ o Marisa Martin & James Landman, “Standing: Who Can Sue to Protect the Environment?” Insights on Law and Society Vol 19 Num 1 (2020): https://www.americanbar.org/groups/public_education/publications/insights-on- law-and-society/volume-19/insights-vol–19—issue-1/standing–who-can-sue-to- protect-the-environment-/ o Lisa Vanhala, “The Comparative Politics of Courts and Climate Change,” Environmental Politics Vol 22 Num 3 (2013): pgs. 447-462. • Zoom Consultation to discuss a working draft of your final memo – due by May 5th: As part of the process of writing your final memo, you must complete a Doodle poll to schedule a Zoom consultation to discuss a working draft, to take place no later than May 5th, 2022. This conversation will count for 10 points and will take approximately 30 minutes. You must sign up for a consultation by Friday, April 8. o To prepare for the conversation, you should submit a draft of at least 3 of the 7 memo pages (on the D2L course site under “Assignments”) no later than the day before our conversation. I want to help you succeed in writing an excellent memo – the more of a working draft you have completed before we chat, the more helpful I can be in working through any questions or challenges with you. o I will not be grading your draft for content (although the 3 pages of writing will count to fulfill the writing-intensive course requirement). My goal is to provide you with helpful feedback at an initial stage and to work through any challenges you may be facing. Provided that you have begun drafting at least 3 pages of the memo and participate in our conversation by May 5, you will get the full 10 points. o One extra credit point will be given to those who sign up/participate early – i.e. in one of the consultation slots for April.
