STEP ONE: Create an assertion
Assertion: Prostitution should be legal. [Would reasonable people take an opposing position on this subject? YES. So now you know that you have a debatable proposition.] This assertion should be a debatable proposition or claim. In other words, it should state a position with which at least some reasonable people might disagree. This would NOT be a debatable proposition: Murder is wrong. [No reasonable person would argue that murder is acceptable.] Here’s another example of an inappropriate assertion: Drunk drivers are a menace to society. [Again, no reasonable person would disagree with this position, so it is not appropriate for an academic argument.]
STEP TWO: List your major reasons (positive supporting arguments).
There is no particular number of reasons required: you may have more or fewer than six. These reasons attempt to answer WHY should prostitution be legal?
Reason 1: Because it is a victimless “crime” enacted by consenting adults.
Reason 2: Because attempting to enforce anti-prostitution laws takes law enforcement officials away from other police business (e.g. preventing and punishing violent offenders).
Reason 3: Because then the government could collect taxes from the world’s oldest business.
Reason 4: Because it is hypocritical for the government to allow a woman to legally have sex for free with hundreds of men, but to lock that same woman up for accepting money for those same acts.
Reason 5: Because legalizing prostitution for consenting adults will simplify the job of law enforcement officials when it comes to finding juvenile prostitutes.
Reason 6: Because we’d see a decline in STD rates in this country (the health of prostitutes could be monitored by the government).
Step Three: Develop the best opposing arguments from your research and your own logical thinking.
In other words, try to step into the shoes of your opponent and articulate his best arguments against your position. List those objections:
Opposing Argument 1: Many people consider prostitution to be immoral.
Opposing Argument 2: People will object to “red-light” districts in their neighborhoods.
Step FOUR: Use your own logic along with what you have learned through your research to create the best counterarguments to the opposition.
Counterargument to Opposing Argument 1:Prostitution might be immoral, but so are fornication, adultery, and cheating on exams. All of those things happen routinely in this country, but the government does not have a compelling interest in any of them.
Counterargument to Opposing Argument 2:the government could sanction special areas within the confines of a building, as is done in Nevada and in certain European countries. We would not have to see prostitutes hanging out on street corners any more anywhere.
STEP FIVE: Work with the assertion until it becomes a polished thesis.
Prostitution should be legal because of many reasons. (vague)
Legalized prostitution would benefit our government and our society. (unclear)
Prostitution should be decriminalized because it is a victimless crime; removing criminal sanctions would benefit law enforcement, the treasury, and public health. (much better)
Step Six: Prepare a scratch outline (include the best opposing arguments and your possible counterarguments to them).
Arrange your points in an order best designed to create an impact. Be sure to counter the opposition immediately after bringing up the opposing point. Notice also in the model scratch outline below that your tentative thesis should be listed first:
Thesis: Prostitution should be decriminalized to effect immediate benefits in terms of law enforcement, tax revenues, and public health.
Introduction
Background (The history of prostitution; prostitution is currently illegal in 49 states; typically the prostitute is arrested while the “john” goes free; most prostitutes are arrested and fined many times). Legalized prostitution in Europe and Asia. What are the results? What do common citizens think? What problems, if any, have there been?
