Punishment and Sentencing
Sentencing is the punishment for a criminal offense after the convict has been proven guilty by the criminal court after conviction in a criminal procedure. Sentencing and punishment for criminals is a practice as old as human civilization. The evidence of this can be found in the Roman, Egyptian, and even the Indus valley civilization. Sentencing and punishment are meant to maintain law and order in society. The main purposes of sentencing are;
Retribution
Retribution is defined as punishment imposed on a criminal for purposes of repayment or revenge for the wrongs committed. It prevents future crime by preventing vengeance and revenge on a personal level. The victim feels satisfied as they see the criminal being punished for the wrongful act they did. When a person or society sees the criminal getting the punishment for a crime, their faith in the judicial system is restored. They feel that they could trust the judiciary and court to maintain law and order in the country, and they don’t need to take the matter into their own hand (Bradley, 2003). It is also important to understand the difference between retribution and restitution. While retribution is associated with giving a sense of avengement, restitution puts financial strain on the defendant. It prevents future crime by putting financial strain on the criminal, which is difficult to recover from, and also puts fear in other members of society against doing the same. Retribution stands on the age-old code of Hammurabi- ‘an eye for an eye. For example, in Sharia law in Islam, the punishment for theft is the amputation of an arm. Under the retributive justice scheme, one can only be punished for the act they did. One cannot be held liable for punishment for an attempt to murder or planning a robbery. The defendant is held accountable for their action, so an insane and intellectually disabled person cannot be penalized.
