Prior to beginning work on this discussion, read Four Kids, Four Crimes, which follows four cases and examines how and why two defendants were tried as juveniles and two were tried as adults. Determining whether to try a child in the juvenile or the criminal justice system will have an impact on every step of his or her experience. Although the exact laws and practices of the systems vary from state to state, broad underlying beliefs differentiate the two systems. While the juvenile system is often thought to be more lenient in its punishments, there are often stricter regulations throughout the process. In the juvenile system, a child may not have a right to a jury trial or bail. Juvenile records are not open to public access like adult criminal records and parole is very different between the two systems. When the child in question is treated by the justice system as a child, the courts act as more of a parent attempting to punish but also protect. Differences between juvenile and adult criminal justice systems exist at every step of the way. Choose one of the cases and answer the following questions:
Which case did you choose? Was the defendant tried as an adult or a juvenile? Evaluate whether you agree with the decision made to try the juvenile as an adult or as a juvenile. What factors did you rely on to arrive at this decision? What scholarly evidence did you use in making your decision? Why is this resource credible and compelling? According to Kantian ethics, the medical practitioners in charge of taking care of the children should apply the principles of health care , which emphasize the moral duty of saving lives. The nurses and doctors are required to treat any baby born prematurely, especially when they have a chance of survival. They should therefore not treat the baby only as a means, but also as an end to themselves. The interests of the parents of the infant are also very essential in this case and should be considered. According to Kant, nothing mattered except having a good will. Morality is a matter of intention, and as long as our intentions are good, the consequences of our actions are not important. The parents want their baby to survive no matter the odds. Their morality and will is jot in question here. The mother even claims that as long as her baby survives, she will not mind if he grows up as a handicapped kid with mental illness conditions. Life is more important to her than the consequences that may accompany her decision to save her baby’s life. This is what Kantian ethics prioritizes, and as long as the parents give consent, the medical practitioners should treat the baby and do everything possible to save his life. Regardless of whether the parents or the medical practitioners like it, Kant insists that moral worth only comes when you do something because you know it fulfills your moral duty.Kantian ethics maintain that if it is in line with their moral duty, they should save the baby’s life by all means necessary .
