Purpose: To gain an understanding how the United States Supreme Court hears cases, and how the Court’s decisions can affect businesses and individuals. Assignment Grading: The assignment is worth 50 points. The assigned case is: Houston Community College System v. Wilson – Docket No 20-804 This is a group assignment. The group will consists of 4 or 5 students. You will be randomly assigned to a Law Firm. One individual will be randomly assigned as lead counsel. Lead Counsel will be tasked with submitting the paper as well as organizing how your group will prepare for the assignment. If your group decides to have someone else act as lead counsel you need to notify me so the change can be made Task: In order to complete the assignment, the group will need to read the briefs filed by the parties in the assigned case. Once oral arguments take place, the group should review those as well. It is possible in the Fall Semester that oral arguments will be scheduled after the semester ends. In that case oral arguments will not be part of the assignment. The briefs of the parties, transcript/audio of the oral arguments will be made available on canvas. There may be amicus briefs (friend of the court) on file as well. When there is an issue of significant importance, non-parties ask for permission to file a brief. You are not required to read those, but they may provide additional insight. You can obtain copies of the Supreme Court pleadings here: Houston v. Wilson You may also review news articles, editorials and other sources for information regarding the case. Provide citations to any sources you rely upon. The Paper: You should write a paper of 3,500 – 4,000 words. Divide the paper into the following topics set forth below. It is not intended that each section be of the same length. The analysis section should be the most in depth section. Include the caption for each section. I. Background: A brief description of the facts that lead up to the case being heard. Be sure to identify the parties, the rulings of the lower courts and the issue on appeal. II. Analysis: Set forth an analysis of the issues. Address the parties’ arguments for their respective positions. Cite to precedent when possible. If you rely on any sources be sure to cite to the authority. Divide this section into Petitioner and Respondent. Keep in mind that there can be more than one argument being presented by both sides. Organize the section accordingly. III. Ruling: Set forth your group’s ruling on the case. Your group should meet and debate the various positions. In this section describe which arguments you found compelling and set forth the basis for your ruling. This section can include a dissent and/or concurring opinions. IV. Effect: Describe how the court’s ruling may impact individuals and businesses alike. Think through the consequences, and consider how different rulings will affect society. V. Prediction: Lastly predict how you believe the Supreme Court will rule. This does not need to be a very long section. However, if you choose to the section may include the vote count, or even how you believe certain justices will rule. Your grade will be based is good part upon the thoroughness of your analysis. Address both side’s arguments and reasoning when making your ruling. The decision you make, meaning which side you rule in favor, will not impact your grade.
