Marcus works at the Sydney Markets. He sells exotic costumes for parties. The goods are made cheap in the Philippines for $1 and he sells them for $22. They are not designed to last beyond 1 or two parties. A customer comes back after using the costume for only 1 party and complains that it is falling apart. Marcus advises him that it is the fault of the manufacturer and he should hire a lawyer in the Philippines to sue the company there. Discuss whether this advice is correct.
Part (b)
Marcus has a friend called Slacker. He specialises in selling a special Christmas novelty called the Bar B Que seat. He requires his customers to send in 3 instalments of $40 over three weeks. However, if his customers default on paying for the seats for any reason, he informs them they have broken the agreement and they forfeit any payments they have made. He claims this is a hire purchase agreement and so it is not a purchase until the final instalment is made.
What advice would you give to Slacker as to the legality of his business model?
Part (c)
Slacker is making so much money from his Christmas Bar B Que seat that he decides to advertise them on television and he sells 30,000 before Christmas. Then, unfortunately, he starts to read stories in the press that when some fat people sit on them or people bounce on them, the seat cracks and the supporting pole causes serious injury. He is shocked but says it is not his fault as he didn’t know. Anyway, he can just issue a warning that they are not suitable for people weighing over 90 kilos and people should not bounce around on them.
What advice would you give to Slacker as to the legal implications for his business?
