The United States government is awaiting the extradition of Julian Assange, the founder of Wikileaks, from the United Kingdom. Assange was originally indicted in 2019 on one-count charging he conspired with Army Pfc. Cheslea Manning to try to hack a government computer password. In 2020, a superseding indictment charged an additional eighteen counts accusing him under the Espionage Act of conspiring with Manning in 2010 to obtain and disseminate classified information. The Obama Administration had considered charging Assange but felt it was a bad idea due to First Amendment concerns that he could be considered a journalist or publisher. That decision, however, was reversed by the Trump Administration although it is said no new evidence had been learned.
Assume for purposes of this question that the indictment is legally viable, was the decision to charge Assange a sound policy one? Do you view it as a slippery slope endangering mainstream journalists who might choose to publish or report on leaked classified information? Of course, that begs the question of whether Assange or Wikileaks should be considered as representatives of the news media? Finally, do you believe Assange will receive a fair trial here in the United States, especially since there is no Public Interest defense available, and what does that look like?
