She is originally from Africa and lives with her husband within a community where other Africans reside. The patient’s husband is present at the bedside. The fetal heart monitor shows late decelerations, which indicate decreased blood flow to the placenta, and the patient is experiencing heavy bleeding. The patient’s provider is at the bedside and has elected to perform an emergency Cesarean Section. When he begins to explain the need for the C-section to the patient and her husband (i.e., active bleeding and fetal distress), the husband interrupts him and refuses the C-section. He states that surgical intervention is frowned upon in their culture. The provider explains to them that unless he performs a C-section, the baby will die and the mother will be at very high risk for hemorrhage and death. The patient’s husband shakes his head again and states, “What will happen is out of our hands.” The patient agrees with her husband and explains that, in their culture, they believe it is better die a natural death. A person who dies during a surgical procedure would not move to the next plane where they will be welcomed by their ancestors. Both the patient and the husband refuse to sign consent for the C-section. Upon their refusal to sign the consent form for the C-section, the provider contacts the house supervisor who contacts the hospital’s legal department. The result of that consultation is that the determination is made that, at this time, the infant’s life overrides the requests of the patient. A court order is obtained and a C-section is performed under duress of the patient and her husband. Following the birth of the infant, the husband refuses any contact it and states that the infant will be shunned by the family and their community. The patient states that she has been dishonored, and while she will be able to take care of her baby, she will be isolated from the rest of the community. • One team will argue the side of the doctor and hospital. • The other team will argue the side of the patient and her husband.
