Learning Goal: I’m working on a public health writing question and need an explanation and answer to help me learn.A major music label in Nashville employs hundreds of employees and has had several incidents relating to employees’ use of the Internet and Social Media, including:* Situation 1: A secretary named Carla has repeatedly complained that she sees her boss looking at porn on his computer at work and it makes her uncomfortable.* Situation 2: A receptionist Fannie is reportedly spending every minute she is not answering the phone playing Candy Crush, Farmville and other games on Facebook. In addition, the company’s marketing department recently started encouraging employees to post company news and promote their country music artists on their personal social media accounts (mainly Twitter, Instagram and SnapChat). In an effort to monitor the effectiveness of this new marketing approach, the marketing department VP began following/friending employees to monitor how they were faring in their efforts to promote the company on their personal social media accounts. Doing so, the VP discovers:* Situation 3. A new hire named Paulie is posting a lot of photographs of himself excessively drinking and partying on his Facebook.* Situation 4. Another employee named Hillary is a Trump hater and a big supporter of the controversial Black Lives Matter movement on her Twitter account.* Situation 5. Someone in the mailroom named Marcus posted videos of himself smoking marijuana with his friends on vacation in Colorado on Snapchat.* Situation 6. Someone in accounting named Elsie runs her own ebay store and offers knock-off purses and other counterfeit goods.Assume you are a team of HR professionals for this company. And a live conference call will be held with the CEO at your scheduled time to get your professional advice on how to handle each one of these situations. The CEO’s administrative assistant wants to give you a heads up and tells you the CEO would like to immediately terminate the boss in Situation 1 and the secretary in Situation 2 if at all possible. To protect the reputation and image of the company, he also wants to terminate the employees (maybe after one warning) posting things on their social media that might be deemed immoral/unprofessional (Situation 3), controversial (situation 4), or that involves illicit drug use (Situation 5) or that constitutes unlawful activity such as trademark infringement (Situation 6).Using the Three Pillar Model Approach be sure to cover the legal, ethical and/or strategic considerations for each of the six situations. For example, you may determine it is legal and ethical but not strategically/economically expedient to terminate the employee watching porn while at work. For help with the legal analysis, you should research each of these situations online using search terms like “outside activity policy,” “managing and leveraging workplace use of social media,” “computer, email, and internet usage,” “workplace privacy,” and “illicit drug use.” And be sure to research laws specific to Tennessee. In addition, I strongly recommend you watch the following short video produced by a law firm I work with: https://www.littler.com/video/2tp20-can-i-fire-employee-disparaging-me-social-mediaThis video provides 4 general questions to ask before firing an employee for disparaging your company on social media? I think you will want to make similar inquiries in order to advise the CEO on the 6 hypotheticals. After the conference call, you should submit a 2-3 page interoffice memo (350-750 words) to document what you told the CEO. Your memo should be appropriately formatted and addressed to the CEO and clearly state your three-part conclusion for each situation and fully explain your rationale.
