You will be assigned another case brief to review and comment on. You must also use the rubric to assess each part of the case brief. Notes on your peer review: The reviews are anonymous, so you won’t know whose brief you’re reviewing, and you won’t know who reviewed yours. You’re not assigning grades, but you’re reviewing the case brief against the standards set out in the rubric below. Make sure to use the rubric in your evaluation—both for assessment and in your comments. Be constructive with your comments. What is good about the case brief? What could use some improvement or additional attention?

Criteria Ratings
This criterion is linked to a Learning Outcome Issue
Identify the legal issues raised by the hypothetical.
Exemplary
Answer identifies the legal issue using appropriate legal terms and explains why the scenario indicates that the issue is raised. The issue statement is concise, shows a command of the topic area and a clear understanding of why the facts presented raise the specific legal issues identified.
Superior
Answer identifies the legal issue raised using appropriate legal terms, and defines those terms with accuracy, with limited misuse of legal terms or definitions. These answers employ the facts from the hypothetical to explain why the issues are raised.
Satisfactory
Answers are able to identify what legal issues are raised, but are not able to identify with clarity the legal terms which should be used to identify those issues, while the student does make clear what legal problems are raised by the hypothetical.
Needs Improvement
Answers are unable to identify the legal issues raised by the hypothetical and demonstrate little or no knowledge of the legal terms and definitions which should be employed to explain why the facts given indicate the issues requiring resolution.
This criterion is linked to a Learning Outcome Rule
Explain what laws apply to resolve the legal issues.
Exemplary
Answer identifies the laws that apply to resolve the legal issue using the correct terms, names the cases the law came from, defines any terms. The answer demonstrates how the rule of law operates to resolve the question raised by the legal issue.
Superior
Answers identify the correct rules of law for application to the legal issue, and can identify how the rule operates with respect to resolving the issue raised.
Satisfactory
Answers identify the rule of law without a complete descriiption of its operation and application, but with an understanding of potential outcomes when surveying the issues raised in light of the general principles of law learned so far.
Needs Improvement
Answers are unable to identify what the rule of law is that should be applied to the legal issues raised by the fact pattern and are consequently unable to provide any application of the correct rule to the fact pattern at issue.
This criterion is linked to a Learning Outcome Application
Apply the rule of the law to the facts of the hypothetical and show evidence of the analytical process to resolve the issue.
Exemplary
This answer uses the facts given, makes independent factual inferences, and applies the rule of law appropriately and thoroughly to the facts to resolve the legal question. The student’s choice of outcome is not per se determinative; rather, their detailed explanation of the application of the rule of law to the legal issue is the most significant facet of this element.
Superior
Answers demonstrate how the rule of law operates to determine the appropriate outcome with relationship to the legal issue raised. These answers use the facts provided by the hypothetical but might not indicate their own inferences based on the given facts. The student should demonstrate an understanding of the operation of the rule of law.
Satisfactory
Answers demonstrate limited application of the rule of the law to the facts which raise the issue. The application may be mechanically flawed but the choice of which rule to be used is correct.
Needs Improvement
Answers demonstrate little or no ability to apply the appropriate rule of law to the issues raised in the hypothetical problem. The answer demonstrates little understanding of the general area of law, the legal issues raised, and the rules of law which would have been applied in resolving the legal issue. Answer may rewrite the facts without discussion of the law.
This criterion is linked to a Learning OutcomeConclusion
Answers the legal question raised in the issue section and concisely states the conclusion.
Exemplary
Succinctly and clearly states the outcome from the application and answers the call of the question.
Superior
Answers the call of the question and addresses the legal issue, though without explanation.
Satisfactory
Discusses the outcome without specifically addressing the call of the question.
Needs Improvement
Does not reach a conclusion.
