Answers are able to identify what legal issues are raised, but are not able to identify with clarity the legal terms which should be used to identify those issues, while the student does make clear what legal problems are raised by the hypothetical.
Needs Improvement
Answers are unable to identify the legal issues raised by the hypothetical and demonstrate little or no knowledge of the legal terms and definitions which should be employed to explain why the facts given indicate the issues requiring resolution.

Exemplary
This answer uses the facts given, makes independent factual inferences, and applies the rule of law appropriately and thoroughly to the facts to resolve the legal question. The student’s choice of outcome is not per se determinative; rather, their detailed explanation of the application of the rule of law to the legal issue is the most significant facet of this element.
Superior
Answers demonstrate how the rule of law operates to determine the appropriate outcome with relationship to the legal issue raised. These answers use the facts provided by the hypothetical but might not indicate their own inferences based on the given facts. The student should demonstrate an understanding of the operation of the rule of law.
Satisfactory
Answers demonstrate limited application of the rule of the law to the facts which raise the issue. The application may be mechanically flawed but the choice of which rule to be used is correct.
Needs Improvement
Answers demonstrate little or no ability to apply the appropriate rule of law to the issues raised in the hypothetical problem. The answer demonstrates little understanding of the general area of law, the legal issues raised, and the rules of law which would have been applied in resolving the legal issue. Answer may rewrite the facts without discussion of the law.
