Carefully read the case of Wisconsin Legislature v. Wisconsin Elections Commission, 595 U. S. ____ (2022) available online at https://www.supremecourt.gov/opinions/21pdf/21a471_097c.pdf and write a one to two page brief (single spaced, 12 point type) that states the essential facts, issue, holding and rationale of the court decision. In addition to the brief, you must include a one to two page (single spaced, 12 point type) analysis of the opinion stating whether you agree with the majority of the Court or with the dissenting justices and, more importantly, why. In your opinion, you can discuss the law and also give your opinion from the perspectives of ethics, social justice and basic fairness. You need not cover the dissenting opinions in your brief itself, though you should at least note the number of justices that joined in the majority opinion and the number of justices that dissented. For guidance on how to brief a case, you can refer to the file on briefing cases that I am also making available in this Blackboard directory. A sample brief is also available in this directory to give you additional guidance and a PDF version of the case in addition to its link provided above.
Because this is a lengthy and complicated opinion, I will allow you to base your brief on the Syllabus of the Court’s opinion. (The three pages of the opinion from the above link.) The Syllabus is not a part of the Court’s opinion, but for purposes of this assignment you can assume that it properly and accurately summarizes the Court’s opinion. (The syllabus is a summary of the opinion written by the clerk of the Court, not by the Justices themselves.) You should read the entire case, including the dissenting opinion, before trying to write your brief or your separate opinion/analysis as to whether you agree with the majority or dissenters.
As to form, I would like you to write you name in the upper right hand corner of the firs page of your brief, followed by the class and section (LEGL 20-DL) on the second line, immediately beneath your name. Then skip a line and place the name of the case and its citation centered on the page. You may then begin writing the brief using the headings per the attached instructions. After completing the brief, begin the second part of the assignment on a new page that you can title “Analysis.”
This is not a research assignment, but if you choose to consult outside sources, you MUST appropriately credit these sources through footnotes, endnotes of citations to avoid plagiarism. Feel free to use outside sources if you need to, but make sure that the written material you hand in is exclusively your own work product. Copying another’s work or allowing your work to be copied by others will result in a grade of “F” on this assignment and a penalty deduction of my full discretionary points on your final grade.
