Background:
More than 100 million cases are filed each year in state trial courts, while roughly 400,000 cases are filed in federal trial courts. Depending on the nature of the crime, offenders may face jail time or prison incarceration if they are convicted. In one study, 77 percent of state prisoners who were released in 2005 had been arrested again by 2010. Recidivism is highest immediately after release. 43% of released prisoners are rearrested during the first year. Judges are now looking to the use of alternatives for incarceration that will save taxpayer money yet still demand an offender be held accountable and impose sanctions for criminal behavior.
