PROVIDE A RESPONSE TO THE FOLLOWING DISCUSSION POST:
I think this offender should be considered for community supervision. According to the Pew Charitable Trusts’ Pubic Safety Performance project (2020), research indicates that while our criminal justice system relies heavily on sanctions to deter criminal actions, positive reinforcement is a better way to encourage desired behaviors. Even after the increase in awareness for domestic violence in the 1970s and a push for better policing in the 1990’s, there is still a culture within law enforcement that policing domestic violence is not proper or real police work (Walkate et al., 2020). With that in mind and regardless of gender, this may be taken into consideration when considering community supervision for this offender. It is important to look into the past history of the offender, as well as any domestic disputes that may have been reported to the police but no charges were filed. Depending on the extent of the abuse, it can be argued that the offender “snapping” was in self defense. It is important to take into consideration the likelihood of reoffending.
I think in this instance community supervision should not be considered. Despite this being an accident, I think it’s important for individuals to remember that driving is a huge responsibility and that cars are potentially dangerous. Sentencing to prison or jail time will not only be a deterrent for the offender upon release but this will serve as a general deterrent to other college students and just people in general who drive vehicles (Carter, 2019). Vehicles are not toys and if no sentence is passed for negligence by the offender there will be no deterrent in the future for them to take driving seriously.
