Project Task 1: Identify Legislative Requirements

To complete this task, the candidates are required to conduct their own research to access sources of information and WHS legal obligations responding to an incident at workplace. Candidates are required to write a report in review the Simulated Workplace Scenario (Appendix 1) and identify the duty holders and legal obligations in relation to provided incident; and outline the recommendations in review aimed to avoid any reoccurrence.

How to complete this task

1. Read the learning module Section 1-2 and the Simulated Workplace Scenario 1 provided – Appendix 1.

2. Review the workplace scenario and prepare a summary report for the organisation’s management in no less than 200 words.

3. Complete the report by use the Report Template – Appendix 2 to address the following:

A. Further to your initial discussion with the Mine Manager you have been requested to prepare a briefing paper/short report in no less than 200 words detailing your assessment of the situation. In particular, you must:
a) Identify the duty holder in relation to this incident;
b) Outline the various legal obligations in relation to this incident. This will include advice as to what legislation applies any why. It will also provide advice on nay reporting requirements that must be met;
c) Compile an initial list of the hazards that might be associated with this incident type and the controls you would expect to be in place;
d) Compile an initial list of the information you would gather to carry out the initial incident notification to your regulatory authority.

B. Given the recurrent nature of this incident, you will also outline any recommendations for:
a) Reviews that should be made of policies, procedures and processes in the workplace; and
b) Strategies for communication of requirements to various stakeholders, that is, identify the critical stakeholders and the communication methods that should be used to reach each of them.
